01 New EU Toy Safety Directive

 

Since November 2019, the EU Toy Safety Directive 2009/48/EC has been updated twice, including adding formaldehyde restriction requirements and tightening aluminum requirements.

 

On November 20, 2019, the European Union issued Directive 2019/1929/EU, which aims to amend Annex C of Appendix II of the EU Toy Safety Directive 2009/48/EC, adding formaldehyde requirements in toys for children under 3 years old and functional entrance toys. These regulations will come into effect on May 20, 2021. The new regulations on the restricted use of formaldehyde are as follows:

02 EU REACH Directive Update

Since November 2019, the EU REACH directive has been updated twice involving authorized substances or restricted substances, with a total of 12 new substances. In addition, the list of substances of very high concern (SVHC) has been updated twice, with a total of 8 new SVHCs added. The SVHC list has been officially updated to 209 items.

 

On February 7, 2020, the European Commission issued Regulation (EU) 2020/171, approving the addition of 11 substances to the authorized substances list of the REACH regulation (Annex XIV of European Commission Regulation (EC) No. 1907/2006).

03 New laws and regulations in various states in the United States

 

On December 16, 2019, the Governor of New York State in the United States signed bill A6041 (S4046), making a warning statement on the lead content in children’s jewelry. Labeling requirements will take effect on January 1, 2021.

 

On February 7, 2020, the Governor of New York State in the United States signed Bill S501B/A6296, which stipulates the declaration rules for chemical substances listed in children's products and prohibits the sale of children's products containing certain chemical substances. The bill states that some substances of high concern need to be declared. The bill officially came into effect on March 1, 2020.

 

In May 2020, the SB447 bill in Maryland, USA, regarding limiting the content of flame retardants in certain products became law and will take effect on January 1, 2021. According to the new law, no one is allowed to import, sell or offer for sale products containing more than 0.1 % flame retardants in certain products. The Maryland Department of Health will enforce the law on or before June 1, 2021.
