For cargo forgery, concealment, misrepresentation, etc., the major shipping companies have notified and stressed the collection of fines, especially the dangerous goods forgery concealment. At the end of last month, the General Administration of Customs held a mobilization meeting for the deployment of the 100-day special action for the comprehensive management of dangerous goods at ports, emphasizing the resolute curbing of false concealment violations.

Yesterday, ONE issued a notice on the imposition of default charges for concealment, omission or misrepresentation of cargo names, which shows that the charges apply to export cargoes shipped from any port in mainland China to all ports of destination. At the same time, ONE also released a list of dangerous goods or non-dangerous chemicals that have been recently concealed or omitted by customers' HF.

ONE stated in the notice that the previous notice calling the charge for concealment, omission or misrepresentation of cargo name as "Special Change Fee" is not entirely accurate and therefore the charge is now renamed as "Liquidated Damages". In addition, ONE said that after the previous notice was issued, it was not strictly enforced, and after the notice was issued, the fee will be strictly enforced according to the standard.

The details and fees are reiterated as follows.

▪ For the case of concealing, omitting or misreporting the name when booking, but the cargo arrives at the port of destination before and after taking the initiative to declare and request to change the name, the non-dangerous cargo with special declaration requirements will be charged with liquidated damages of USD 3,000/ctn and dangerous goods with liquidated damages of USD 15,000/ctn

For the case that the shipping company finds that the name is concealed, omitted or wrongly declared by the shipping company and the name has to be changed compulsorily, the penalty for breach of contract is US$6,000/ctn for non-dangerous cargo with special declaration requirement and US$30,000/ctn for dangerous goods.

Note: 1. Non-hazardous cargo with special declaration requirements, including but not limited to cargo with special loading requirements, non-hazardous chemicals and batteries, etc.

 2. This charge is applicable to export cargoes from any port in mainland China to all ports of destination.

 3. The shipping company has the right to detain the cargo and refuse the request of name change until the customer pays the charge in full.
