recently,Wanhai Shipping issued a solemn reaffirmation of the relevant notice regarding the concealment/under-reporting/mis-reporting of cargo.
Wanhai Shipping stated that it will pursue full and unlimited compensation from the responsible party in accordance with relevant international conventions and the terms of the transportation contract. It also emphasized that if a crime is constituted, it will be handed over to the judicial department without hesitation to investigate its criminal responsibility. There will be no leniency or tolerance.
The specific contents are as follows:
In order to ensure the safety of ships, cargo and other third parties, provide a safe maritime transportation environment, and protect the interests of our customers, Wanhai Shipping once again emphasizes that all customers must declare their goods truthfully and correctly. In case of any incorrect declaration, such as concealment/omission/misreporting of goods, the carrier has the right to charge liquidated damages from the cargo party in accordance with the agreement between the two parties when they entered into the transportation contract:
(a) Dangerous goods boxes must provide true CLASS, UNNO, detailed product name, dangerous goods declaration form and packaging certificate.In the event of concealment, omission, or discrepancy with the actual goods, Party A must pay liquidated damages of USD100,000/UNIT once discovered.And pay it within 7 days after Party B’s notification.
(b) If the goods that are concealed, omitted or misdeclared are non-dangerous goods, Party A shall pay liquidated damages USD100,000/UNIT and bear all risks, liabilities and all loss compensation expenses incurred thereby. And pay it within 7 days after Party B’s notification.
(c) If there are concealed, omitted or misdeclared goods, Party A must immediately pay USD 100,000/UNIT as a deposit after being notified by Party B. The relevant deposit will be used for subsequent expenses such as container damage, overdue fees for the detention period (overdue fees involving concealed declarations shall be calculated as three times), terminal fees, local customs-related processing fees, etc., as well as bear all risks, responsibilities and all loss compensation expenses arising from safety accidents. If there is any shortage, it must be made up. And pay it within 7 days after Party B’s notification.
It is worth noting that in addition to the above liquidated damages and deposits, Wanhai Shipping will also reserve the right to make claims against the responsible party and pursue its legal liability.
