Recently, many companies have inquired about issues related to the transportation of dangerous goods by water and air. Today, we will focus on the recent focus of enterprises and take a look at how to standardize the filling and transmission of original manifests for dangerous goods transported by water and air.

 

What are the basis?

 

"Measures of the Customs of the People's Republic of China for the Management of Inbound and Outbound Conveyance Manifests" (announced by General Administration of Customs Order No. 172, modified in accordance with General Administration of Customs Orders No. 235 and 240) and "Announcement on Adjustments to Matters Related to the Management of Water and Air Transport Manifests" (General Administration of Customs Announcement No. 144 of 2019) and other relevant announcements.

 

What is the time requirement for transfer?

 

The person responsible for the electronic manifest data transmission (hereinafter referred to as the "manifest transmitter") shall transmit the electronic manifest data of imported goods to the customs in the form of electronic data within the following time limit:

1. For inbound container ships, 24 hours before the goods start loading; for container goods transshipped through overseas ports, 24 hours before loading at the last overseas transshipment port.

 

2. For incoming non-container ships, 24 hours before arriving at the first port of destination in the country; if the voyage is within 24 hours, before arriving at the first port of destination in the country.

 

3. If an incoming ship carries container and non-container cargo at the same time, it shall be transported separately in accordance with items 1 and 2.

 

4. Inbound passenger and cargo liner (voyage less than 24 hours), 2 hours before starting to load cargo.

 

5. Other short-distance ships entering the country (voyage less than 24 hours), 4 hours before starting to load cargo.

 

6. When goods are transshipped at domestic ports, they should be carried out before the incoming ship arrives at the unloading port.

If the inbound flight is less than 4 hours, before the aircraft takes off; if the flight exceeds 4 hours, it is 4 hours before the aircraft arrives at the first domestic destination port.

 

How to standardize filling in?

 

The manifest transmitter shall fill in the manifest data items in accordance with the specifications to ensure thatVerify that the data is true, accurate and valid.

 

For the filling conditions and filling specifications of the "Original Manifest Data Items", please refer to Annex 1, Annex 14 and Annex 15 of the General Administration of Customs Announcement No. 144 of 2019.

 

The specifications for filling in data items related to dangerous goods are as follows: The manifest transmitter should accurately fill in the manifest data information such as the dangerous goods number, the name and contact number of the dangerous goods contact person.

Enter the name of a contact person who can provide details of the dangerous goods shipment.

If the consignee of the original manifest is "TO ORDER", the contact number of the notifier must be filled in.

 

If the communication method category code is TE (telephone), fill in the telephone number in the international standard format (international prefix country code area code telephone number).

 

If the communication method category code is FX (telex), fill in the telex number in the international standard format.

 

If the communication method category code is EM (email), fill in the email address that meets the standards.

According to the data item filling requirements, if there is an association between data items, if one of the data items is filled in, the associated data items must also be filled in.

 

The name of the dangerous goods contact person, the contact number of the dangerous goods contact person, and the communication method category code are examples of situations where there is an association between the above data items.

 

What are the consequences for filling in the wrong form?

 

According to Article 22 of the "Regulations on the Implementation of Customs Administrative Punishments of the People's Republic of China", failure to transmit manifests and other electronic data to the customs within the prescribed time limit, inaccurate electronic data transmitted, or failure to save relevant electronic data within the prescribed time limit will affect customs supervision. If found, a warning will be given and a fine of not more than 50,000 yuan may be imposed. If there are any illegal gains, the illegal gains will be confiscated.
